Terms of Service — Epic Cloudflare OS

These Terms govern purchase of licenses and subscriptions for Epic Cloudflare OS and the private epic-cloudflare-os-kit. By completing Stripe Checkout or using the software, you agree to these Terms.

1. What you are buying

Not investment products. No guaranteed profits, tokens, yield, or financial returns.

2. Local vs hosted billing

1. Local runtime is not platform-metered. After valid Repo Access, running on your machine does not incur Epic usage fees. You pay your own model/API providers (BYOK).

2. Hosted/production use requires an active Hosted Pro or Team subscription.

3. Repo Access does not include unlimited free hosted production.

3. License grant

Subject to payment and these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the software as described for the product purchased. You may not:

• Resell, sublicense, or publicly redistribute private kit materials
• Remove proprietary notices
• Use the service for unlawful, fraudulent, abusive, or scam activity
• Attempt to bypass billing, entitlements, rate limits, or security controls
• Reverse engineer except where permitted by law

4. Accounts and eligibility

You must provide accurate information, be able to form a binding contract, and comply with export and sanctions laws. One person per consumer account unless Team seats apply.

5. Payments (Stripe)

All card payments are processed by Stripe. We do not store full card numbers or CVV. Prices are in USD unless stated. Taxes may apply. Subscriptions renew monthly until canceled.

5.1 Seedance / AI video credits

1. Credits are prepaid. You must complete Stripe Checkout before generation.

2. Each successful generation attempt consumes one credit when the job is approved/applied (debit occurs before the model run).

3. Failed provider runs after debit may be eligible for manual credit restore at our discretion if the failure is our infrastructure fault — not for content-policy rejections or user prompt errors.

4. AI outputs are synthetic media. You are responsible for review, rights, disclosures, and lawful use before publishing.

5. Third-party model providers (e.g. ByteDance via Cloudflare) may apply their own safety filters; we may refuse prompts that violate our AUP.

9. Disclaimers

Software is provided “AS IS” without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. AI outputs may be incorrect; you remain responsible for decisions.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising from a purchase is limited to the amount you paid us for that product in the three (3) months before the claim. We are not liable for indirect, incidental, special, consequential, or lost-profit damages.

11. Indemnity

You will indemnify us against claims arising from your misuse, illegal use, or violation of these Terms.

12. Termination

We may suspend access for AUP or non-payment. You may cancel Hosted subscriptions via Stripe. Local license ends if obtained fraudulently.

13. Changes

We may update Terms by posting a new version. Material changes apply prospectively.

14. Governing law

Unless mandatory consumer law says otherwise, these Terms are governed by the laws of the United States and the State of Texas (or your stated business state if updated in writing), excluding conflict-of-law rules.
